1. Scope
Fund That provides commercial financing brokerage and related financing-support services to Canadian businesses. This policy applies when you visit our website, submit a financing or dealer-partner request, communicate with our team, book an appointment, sign documents, or otherwise provide personal information to us.
Depending on the circumstances, our handling of personal information may be governed by the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and/or applicable provincial private-sector privacy laws. We aim to apply privacy practices that are appropriate to the sensitivity of the information and the purpose for which it is collected.
2. Information we collect
The information we collect depends on how you interact with Fund That. It may include:
- Identity and contact information: name, business title, email address, telephone number, mailing or business address and preferred contact method.
- Business information: legal and operating names, business structure, industry, time in business, website, location, ownership information and other business-profile details.
- Financing-request information: requested amount, financing type, intended use of funds, timing, equipment or asset details, vendor or seller information and information about the proposed transaction.
- Financial information: business revenue, financial statements, banking information, debt information, tax or accounting records, transaction documents and other financial information that may be required to evaluate or submit a financing request.
- Credit, identity and verification information: information used to verify identity, business ownership, creditworthiness, fraud risk or eligibility where you authorize or where applicable law permits us to obtain or use it.
- Application and consent records: application status, consent selections, timestamps, electronic-signature records, communications and records of documents provided.
- Website and attribution information: IP address, browser/device information, pages visited, referral information, landing pages and advertising identifiers such as UTM parameters, GCLID, FBCLID or similar campaign identifiers when available.
- Dealer or partner information: information submitted by businesses that apply to participate in a Fund That dealer or referral program.
We seek to collect only information that is reasonably necessary for the purposes identified to you. We do not ask applicants to send sensitive financial information through ordinary email unless we have specifically instructed them to use an appropriate secure method.
3. How we use information
We may use personal information to:
- receive, review, manage and follow up on commercial financing requests;
- understand your business, financing needs and potential eligibility;
- identify lenders, lessors or other financing providers that may be relevant to your request;
- prepare and submit financing packages to financing providers with your authorization or as otherwise permitted by law;
- communicate with you, schedule meetings and provide status updates;
- request supporting documents and perform appropriate identity, fraud, compliance, credit or business verification steps;
- prepare, send and administer agreements, including electronic-signature documents;
- administer fees or payment obligations that are separately disclosed and agreed to in writing;
- operate, secure, troubleshoot and improve our website, systems and services;
- measure advertising and website performance and preserve lead-source attribution;
- maintain records, prevent fraud, manage disputes and comply with legal, regulatory, accounting or contractual obligations; and
- carry out other purposes that we identify at or before the time of collection, or that are otherwise permitted or required by law.
4. How we share information
Fund That is a commercial financing broker. To explore or arrange financing options, we may disclose relevant application and business information to third parties that are reasonably involved in the financing process, including:
- banks, credit unions, finance companies, leasing companies and other lenders or financing providers;
- credit-reporting, identity-verification, fraud-prevention, bank-verification or similar service providers where authorized or permitted;
- technology providers that support our CRM, document collection, electronic signatures, appointment booking, communications, hosting, analytics, security and business operations;
- professional advisers such as lawyers, accountants, auditors or collection professionals where reasonably required;
- government, regulatory, law-enforcement or other authorities where disclosure is required or permitted by law; and
- a purchaser, successor or other party involved in an actual or proposed corporate transaction, subject to appropriate confidentiality and legal requirements.
Submitting a request to Fund That does not mean that your information will automatically be sent to every financing provider in our network. We use and disclose information in relation to the financing process based on the purpose of the request, your instructions or consent, provider requirements and applicable law.
5. Credit, identity and verification information
Some financing providers require credit, identity, banking, ownership or other verification information before they can evaluate an application. If such information is required, Fund That or a participating financing provider may ask you to provide additional consent or complete a separate authorization before a credit inquiry, identity check, bank-data connection or other verification is performed.
The initial website funding request is not, by itself, a blanket authorization for every possible credit or verification activity. Where a separate authorization is legally or operationally required, we will obtain it through the applicable application, consent or agreement process.
6. Communications and marketing
When you submit a financing request, dealer inquiry, contact form or appointment request, you authorize us to communicate with you as reasonably necessary to respond to that request and administer the relationship.
Promotional or marketing emails and text messages are handled separately and are sent only where we have a lawful basis to do so. Where Canada’s Anti-Spam Legislation (CASL) applies, commercial electronic messages will include required identification information and an unsubscribe mechanism. You may withdraw consent to promotional messages at any time, but doing so does not prevent us from sending transactional or service-related communications that are necessary to administer an active request or agreement.
8. Retention
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to administer financing or business relationships, satisfy lender or contractual requirements, resolve disputes, maintain appropriate business records and meet legal, regulatory, tax, accounting or compliance obligations.
Retention periods may vary depending on the type and sensitivity of the information, whether an application proceeds to funding, the systems in which records are stored and the requirements that apply to the particular transaction.
9. Safeguards
We use administrative, technical and physical safeguards that are intended to be appropriate to the sensitivity of the information under our control. These may include access controls, restricted permissions, secure service providers, authentication measures, logging, secure transmission methods and internal procedures.
No website, network, storage system or electronic transmission can be guaranteed to be completely secure. If we become aware of a privacy or security incident, we will assess and respond to it in accordance with applicable law and our internal procedures.
10. Your privacy rights
Subject to applicable law and permitted exceptions, you may request access to personal information that we hold about you and ask us to correct information that is inaccurate or incomplete. You may also withdraw consent to certain uses or disclosures where consent is the legal basis, subject to legal, contractual and operational restrictions.
We may need to verify your identity before completing a privacy request. If withdrawing consent would prevent us from continuing a financing request or providing a service, we will explain the consequences where appropriate.
11. Service providers and processing locations
We use third-party technology and service providers to support our business. Depending on the provider and service, personal information may be stored or processed outside your province or outside Canada. When information is processed in another jurisdiction, it may be subject to the laws and lawful-access requirements of that jurisdiction.
We remain responsible for personal information under our control and use contractual, organizational or other measures appropriate to the circumstances when engaging service providers.
12. Minors
Fund That’s commercial financing services are intended for businesses and individuals who are legally able and authorized to act for those businesses. Our services are not directed to children, and we do not knowingly solicit financing applications from minors.
13. Changes to this policy
We may update this Privacy Policy as our services, technology, legal requirements or business practices change. The effective date at the top of this page identifies the version currently posted. Material changes may also be communicated through the website or another appropriate method.
